Terms of Service for Northline Drawing Atelier

1. Introduction and Acceptance of Terms

These Terms of Service (the “Terms”) govern your access to and use of the services, classes, workshops, sessions, coaching, lessons, programs, website, booking channels, and related offerings provided by Northline Drawing Atelier (“Northline Drawing Atelier,” “we,” “us,” or “our”).

By booking, registering for, attending, purchasing, or otherwise using any of our services, you agree to be bound by these Terms and all applicable laws and regulations in Canada, including applicable provincial and federal laws. If you do not agree to these Terms, you must not use our services.

If you are accepting these Terms on behalf of a child, teen, organization, or other person, you represent and warrant that you have the legal authority to do so.

2. Scope of Services

Northline Drawing Atelier is a drawing-studio business offering the following services, which may be delivered in person, online, or in a hybrid format as described at the time of booking:

  • Beginner drawing classes
  • Figure drawing sessions
  • Sketching and observational drawing workshops
  • Portfolio development coaching
  • Private one-on-one drawing lessons
  • Children's and teen art classes
  • Corporate creative workshops

We may modify, suspend, or discontinue any service, schedule, instructor assignment, venue, or format at any time, subject to any applicable law and any specific written agreement with you.

Unless expressly stated otherwise, our services are educational and creative in nature and do not constitute professional advice, therapy, counseling, medical treatment, or certification.

3. User Obligations and Responsibilities

By using our services, you agree to:

  • Provide accurate, current, and complete information when registering, booking, or communicating with us.
  • Comply with all studio rules, safety instructions, age requirements, and instructor directions.
  • Behave respectfully toward staff, instructors, models, other participants, and property.
  • Arrive on time and attend sessions prepared with any required materials, unless materials are provided by us.
  • Not engage in harassment, discrimination, disruptive conduct, intoxication, vandalism, theft, or any unlawful activity.
  • Supervise minors where required and ensure that any minor participant has appropriate consent and authorization.
  • Not record, photograph, livestream, or otherwise capture sessions where prohibited, including figure drawing sessions or any session involving privacy-sensitive content, unless we give prior written consent.
  • Follow any health, safety, accessibility, or venue-specific policies communicated by us.

You are responsible for your own personal property. We are not responsible for lost, stolen, or damaged personal items, except to the extent required by applicable law.

We reserve the right to refuse admission, remove any participant, or terminate services without refund if a participant violates these Terms, disrupts the learning environment, or creates a safety risk.

4. Payment Terms and Conditions

Fees, taxes, and any applicable charges will be disclosed at the time of booking or purchase. Unless otherwise stated, all prices are in Canadian dollars (CAD).

  • Payment is due in full at the time of booking unless a payment plan or invoice arrangement is expressly approved by us in writing.
  • We may require deposits for certain services, private lessons, corporate workshops, or custom programs.
  • Applicable taxes, including GST/HST where required, will be added as applicable.
  • Failure to pay on time may result in cancellation of your booking, suspension of access, or late fees where permitted by law and disclosed in advance.
  • Chargebacks or payment disputes initiated in bad faith may result in immediate suspension of services and collection of outstanding amounts.

For corporate creative workshops and custom bookings, additional terms may apply in a written proposal, invoice, or service agreement. If there is a conflict between those terms and these Terms, the written agreement will prevail to the extent of the conflict.

5. Cancellation and Refund Policy

Our cancellation and refund policy may vary depending on the type of service booked. Any service-specific policy disclosed at booking forms part of these Terms.

  • Classes and workshops: Cancellations made within the stated cancellation window, if any, may be eligible for a refund, credit, or rescheduling at our discretion and subject to the specific booking terms.
  • Private lessons and coaching: Missed appointments or late cancellations may be charged in full or partially, unless otherwise required by law or agreed in writing.
  • Children's and teen classes: Cancellations and refunds may be subject to additional notice requirements and administrative fees, where permitted by law.
  • Corporate workshops: Deposits may be non-refundable. Custom planning, preparation, and reserved studio or instructor time may be billed even if the event is cancelled.

If we cancel a session, class, or workshop, we may offer a refund, credit, rescheduling, or alternative arrangement at our discretion, subject to applicable law and any specific written agreement.

Refunds, if approved, will generally be issued to the original payment method within a reasonable time. Processing times may vary depending on your financial institution.

Nothing in these Terms limits any non-waivable consumer rights under applicable Canadian law.

6. Liability Limitations

To the fullest extent permitted by applicable law, Northline Drawing Atelier, its owners, directors, officers, employees, contractors, instructors, agents, and representatives shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of our services.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the services shall not exceed the amount you paid to Northline Drawing Atelier for the specific service giving rise to the claim.

You acknowledge that participation in art classes, figure drawing sessions, workshops, and studio activities may involve ordinary risks, including but not limited to slips, trips, falls, use of tools or materials, allergic reactions, strain, or other injuries. You participate voluntarily and assume all risks inherent in the activity, except to the extent caused by our gross negligence, wilful misconduct, or as otherwise prohibited by law.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for gross negligence, wilful misconduct, fraud, or any mandatory statutory obligations.

7. Intellectual Property Rights

All content provided by Northline Drawing Atelier, including but not limited to lesson plans, handouts, worksheets, images, videos, designs, logos, text, course materials, and website content, is owned by or licensed to Northline Drawing Atelier and is protected by applicable intellectual property laws.

You may use our materials solely for your personal, non-commercial educational purposes, unless we expressly permit otherwise in writing. You may not reproduce, distribute, modify, publicly display, sell, sublicense, or create derivative works from our materials without prior written consent.

Unless otherwise agreed in writing, any artwork, sketches, studies, or portfolio materials created by you during a session remain your property. However, you grant Northline Drawing Atelier a non-exclusive, royalty-free, worldwide license to use photographs or reproductions of your work for internal records, educational purposes, marketing, or promotional use only with your prior consent where required by law or where the work includes identifiable personal information.

If a session includes models, participants, or third-party materials, you must respect all privacy, publicity, and intellectual property rights associated with those persons or materials.

8. Data Protection and Privacy

Northline Drawing Atelier collects, uses, discloses, and retains personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy legislation.

We may collect personal information such as your name, contact details, billing information, emergency contact information, age or guardian details for minors, attendance records, and communication preferences for the purposes of registration, scheduling, payment processing, customer support, safety, and service improvement.

We may share personal information with service providers that assist us with payment processing, booking systems, email communications, or other operational functions, subject to appropriate confidentiality and data protection safeguards.

We will take reasonable administrative, technical, and physical measures to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

By using our services, you consent to the collection, use, and disclosure of your personal information as described in our privacy practices and as reasonably necessary to provide the services. Where required by law, additional consent will be obtained.

9. Force Majeure

Northline Drawing Atelier shall not be liable for any delay, cancellation, failure to perform, or interruption of services caused by events beyond our reasonable control, including but not limited to natural disasters, fire, flood, severe weather, power outages, epidemics, pandemics, public health orders, labour disputes, government actions, transportation disruptions, venue closures, or internet/service provider failures.

In the event of force majeure, we may reschedule, modify, suspend, or cancel services and may offer credits, refunds, or alternative arrangements where appropriate and required by law or by any specific written agreement.

10. Changes to Terms

We may update or revise these Terms from time to time to reflect changes in our services, business practices, or legal requirements. The updated Terms will be posted or otherwise made available with a revised effective date.

Your continued use of our services after the updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our services.

11. Applicable Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Subject to any mandatory consumer protection laws or other non-waivable legal rights, you agree that the courts located in Toronto, Ontario shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the services provided by Northline Drawing Atelier.

13. Severability Clause

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

If any invalid or unenforceable provision can be modified to make it valid and enforceable, it shall be interpreted and enforced to the maximum extent permitted by law in a manner that most closely reflects the original intent of the provision.

By booking or using the services of Northline Drawing Atelier, you acknowledge that you have read, understood, and agreed to these Terms of Service.
